Big Changes for Home Buyers: Understanding the Mandatory Buyer Representation Agreement

If you’re in the market for a new home, there’s a big change you need to be aware of. As of August 17th, 2024, all buyers must sign a Buyer Representation Agreement before viewing any residential property.

I know what you’re thinking—Can’t we just go look at the house? Unfortunately, no. This is a legally binding change that affects every REALTOR® nationwide, and I want to make sure you fully understand how it impacts you.

Let’s break it down.

What Is the Buyer Representation Agreement?

Think of this as a formal agreement between you (the buyer) and me (your REALTOR®). It outlines:
The details of our professional relationship – How I will assist you throughout the buying process.
My responsibilities to you – Including market research, property tours, contract negotiations, and more.
Compensation terms – How my commission is handled in your transaction.

This agreement must be signed before I can show you any homes. It ensures transparency, protects your interests, and clarifies how I will advocate for you during your home search.

Does This Mean Buyers Have to Pay Realtor Commissions?

Well, yes… but actually, maybe no.

The Buyer Representation Agreement states that the buyer is responsible for the agent’s commission. However, that doesn’t mean you’ll always be paying it out of pocket.

Here’s why:
Sellers or listing brokers may still cover the commission – It depends on how the offer is structured.
There are different ways to handle commission negotiations – I can guide you through this.

Why Is This Happening?

Historically, sellers paid the listing broker a commission, and the listing broker paid a portion of that to the buyer’s agent. However, this led to misunderstandings, with many buyers believing that sellers directly paid their agents.

This misunderstanding resulted in a major class-action lawsuit, leading to a settlement that changed the way real estate commissions are handled. Now:
Buyer’s agents are no longer guaranteed compensation through the MLS.
Commission agreements must be made directly between the buyer and their agent.
MLS listings can no longer advertise compensation for buyer’s agents.

This means that buyers now need to have a formal agreement in place to ensure they are properly represented.

What If I Want to Change Agents?

Good news—you’re not locked into anything.

A few key facts about the Buyer Representation Agreement:
You can cancel at any time – There is language in the agreement that allows for termination.
It only lasts a maximum of 3 months – But it can be shorter or extended if needed.
It can be limited to specific properties, price points, or locations – Want one agent for residential properties and another for land purchases? That’s possible.
